WHEREAS, the Pierce County Board of Commissioners directed the County Highway Superintendent to study the use of the County Road 861 Between 534 and 535 Avenues. The road is located between Sections 18 and 19, Townships 27 North, Range 4 West of the 6th Principal Meridian, Pierce County Nebraska.
WHEREAS, a written report of the use of the road has been completed by the Highway Superintendent and is filed with the County Clerk
NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of Pierce County, Nebraska, that a public hearing date be set for January 5th, 2026 at 9:11 A.M. to consider whether or not to vacate or abandon road. The County Clerk is hereby directed to send copies of this resolution by registered or certified mail to the abutting and adjacent landowners.

In the past the County had mowed along roads but the COUNTY WILL NOT BE MOWING in 2024. It is the duty of the landowner or farmer to mow all roadway ditches running along their land twice a year, before July 15th and again by September 15th. If the County has to mow the roadway, then the Board will bill the landowner upon the abutting land to pay for the mowing expense at $300.00 per mile (SS 39-1811).
It is also the responsibility of the landowner or farmer to see that no irrigation water infringes on county right-of-way, there is NO planting within the county right-of-way (33’ from center of road) as it will be mowed (SS 39-1702 and 39-1812), hedges or trees that become a public nuisance to travel on roads or obstruct the view of railroad crossings or crossroads need to be trimmed and if a landowner fails to trim these trees, the County will hire the work done and the cost will be assessed to the property (SS-39-1702-1812) and the Noxious Weed Act requires landowners to control all noxious weeds on their property, which includes road ditches (SS 2-945).
Violators will be prosecuted.
